Alacrity Solutions Group, LLC (“Alacrity Solutions”) and its affiliates (collectively, “us”, “we”, or “our”) respects your privacy. This Privacy Statement (“Statement”) explains how we collect, use, disclose and protect the Personal Information (as defined below).

This Privacy Statement applies to all Personal Information collected by us:

  • on https://www.alacritysolutions.com and any other website or mobile application that links to this Statement (collectively, the “Sites”);
  • when you engage with our solutions or services; and
  • when we otherwise interact with you (by email, telephone or otherwise)

By using the Services, you agree to the collection, use, and disclosure of Personal Information in accordance with this Statement.

DEFINITION

Cookies” are small web files that a site or its provider transfers to your device’s hard drive through your web browser that enables the site’s or provider’s system to recognize your browser and remember certain information.

Personal Information” means information about an identified or identifiable individual, and includes the personal information of our customers and users of our Services.

INFORMATION WE COLLECT

When you use our Services, we may collect or receive Personal Information about you to provide our Services and operate our business, including information you provide to us, information we automatically collect, and information we obtain from third parties.

Information You Provide

You may provide your Personal Information to us when you use our Services, including when you create an account through the Sites (an “Alacrity Account”), use the Sites, contact us with inquiries, or otherwise access our Services. This information may include:

  • Contact and identification information, such as your name, postal address, telephone number, and email address;
  • Work address, vehicle information (such as VIN, make, model, and license plate), claim number, and policy number;
  • Photos, receipts, and other supporting documentation about a claim;
  • Billing or payment data to facilitate claim payments;
  • Login and access credentials, such as your username and password for the Sites; and
  • Information you include in your communications with us or in connection with a satisfaction or research survey (including demographic information, such as your age, gender, and occupation).

Information We Collect by Automated Means

We may receive and store certain information about you and your device(s) automatically when you access or use our Services. This information may include:

 

  • Technical Information– We collect technical information associated with your activity on the Sites and may include information related to your browser and operating system, IP address (the internet address of your computer) unique device identifiers, and other information such as your device type. We use such information for diagnostic and statistical purposes and to administer our Services.

 

  • Site Usage Information– We collect information to better understand customer traffic patterns and the Sites usage. This may include the webpage that you were visiting before accessing the Site or mobile application, the pages or features of the Site you browsed to inform us which part of the Sites and Services you visit and how much time you spend there. This information is used to analyze and improve the Sites and to provide our customers with a better user experience.

 

  • Site Preferences – We collect information about your preferences to make your use of the Sites more productive through the use of Cookies.

 

Information We Collect from Other Sources

We may supplement information collected through our sites with information obtained from other businesses, such as updated addresses or phone numbers we obtain from vendors who maintain such data.  We may also obtain information from public sources, such as information you submit in a public forum (for example, a customer review).

HOW WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES

 

When you visit our Sites, we may collect certain information by automated means, using technologies such as Cookies, Web server logs, and Web beacons. This information may be used to provide a better-tailored experience on our Sites, and for market research, data analytics, and system administration purposes. For instance, we may use this information to determine whether you’ve visited us before or are new to our Sites, to store your preferences and settings, to provide sign-in authentication, and for compliance with our legal obligations, policies, and procedures.

Our Sites may use Cookies. We use first-party and third-party Cookies for the following purposes:

  • to make our Services function properly;
  • to improve our Services;
  • to recognize you when you return to the Sites or the Services and to remember information you have already provided and your preferences;
  • to collect information about your activities over time and across third party websites or other online services in order to deliver content and advertising tailored to your interests; and
  • to provide a secure browsing experience during your use of our Services.

Your browser may provide the ability to be notified when you receive certain types of Cookies and how to restrict or disable certain Cookies. Please note, however, that if you disable Cookies, you may not be able to use all of the features and functions of our Sites.

Our Sites may use Web server logs to record information about your Site visits, such as your device type, operating system type, browser type, domain, system settings, and IP address, as well as the language your system uses and the country and time zone where your device is located. These logs also may record information such as the address of the Web page that referred you to our Sites, and other information about your interaction with our Sites, such as which pages you visit. This is a common practice that supports the operation of our Sites.

Our Sites and e-mails may also contain tags known as “Web beacons” or “single-pixel gifs,” which are small electronic images used to help deliver Cookies from our Sites, count visitors to our Sites, and determine whether e-mails are opened.  We may use third-parties to place and analyze Web beacons, and these third-parties may also set or read a cookie on your computer.

We may also use third-party Web analytics services in our Sites, such as those provided by Google Analytics. HOW WE USE INFORMATION

We may use the Personal Information we collect for a range of business purposes, including to:

  1. To Provide You With Our Services

 

We use your information to provide you with the Services. For example, we use credit card information to complete a transaction, or use the Personal Information to create and manage your Alacrity Account. Further, if the applicable information is to be provided or Service is to be performed by a third party, then we will disclose the applicable Personal Information to the third party providing the information or performing applicable Services. Your information may be available or provided to third-party service providers (such as credit card companies, and payment processing companies) and that are contractually obligated to protect your information as disclosed in this Statement.

 

  1. To Maintain, Improve, and Personalize the Services

 

We use your information for our everyday business operations such as auditing, administration of the Services, forum management, fulfillment, and analytics. Your information may also be used to improve the content and/or functionality of the Services. For example, it may be used to help us improve our offerings. We also use your information to personalize your experience. We may personalize the content and features you see when visiting our Services. In addition, we may personalize advertisements, marketing communications, and recommendations to make them more tailored to your interests.

We use your information to communicate with you. We may contact you with promotional offerings or other communications that may be of interest to you. If we send you marketing emails about Services that may interest you, each email will contain instructions permitting you to “unsubscribe” from receiving future marketing or other communications within ten (10) days.

 

In the event you contact us, we use certain information to respond to your questions and assist you with any issues that may arise in your use of the Services, or evaluate and respond to your requests, inquiries, and applications.

We care about keeping you secure and safe while using our Services. Keeping you safe requires us to process your Personal Information, such as your device information, activity information and other relevant information. We use such information to combat spam, malware, malicious activities or security risks; improve and enforce our security measures; and to monitor and verify your identity so that unauthorized users do not gain access to your information.

Our Services are subject to certain laws and regulations which may require us to process your Personal Information. For example, we process your information to fulfill our business obligations, or as necessary to manage risk as required under applicable law.

When you access or use our Services, you are bound to the applicable Terms of Use for the Services and this Policy. To ensure you comply with them, we process your Personal Information by actively monitoring, investigating, preventing and mitigating any alleged or actual prohibited, illicit or illegal activities on our Services. We also process your Personal Information to: investigate, prevent or mitigate violations of our internal terms, agreements or policies; and enforce our agreements with third parties and business partners.

We use your information to protect you, others, and our business, including, without limitation, using information for fraud prevention, for enforcement of our Terms of Use, to comply with the law, to protect against security risks, and investigate and manage claims, risk exposure, and quality.

HOW WE SHARE INFORMATION

We do not sell, trade, or otherwise transfer Personal Information to unaffiliated third parties (companies outside the Alacrity Solutions) without your consent, except as described below.

Affinity Partners

In limited cases, we may disclose limited Personal Information (generally contact information) about our customers or contractors to trusted third-parties who may use the information to market their own products and services to the customers or contractors.  For instance, we may provide information to a business who has agreed to offer our customers or contractors a discount or other exclusive offers.

Insurance Carriers

In limited cases, we may disclose limited Personal Information about our policyholder customers to select insurance carriers for the purposes of identifying common customers for potential cooperation and further developing our products and services. In these instances, we do not authorize the recipient insurance carrier to use your information, except to the extent it is already known by them, for any other purpose without your consent.

Service Providers

We may disclose your Personal Information to companies that provide services to us (such as providers of hosting, support, delivery, printing, e-mail, and data enhancement) or that help us market our products and services. These companies may need access to information about you in order to perform their functions. These companies are generally not authorized to use the information we disclose to them for any other purpose without your consent.

Legal, Enforcement, Security, and Investigation

We may disclose information about you (1) if we believe we are required to do so by law, regulation or legal process, such as a court order or subpoena; (2) as we deem appropriate or necessary in response to requests by government agencies, such as law enforcement authorities or tax authorities; (3) when we believe disclosure is appropriate or necessary to protect the rights, property, or safety of Alacrity Services, our customers, our employees, or others, including to prevent physical, financial or other harm, injury or loss, or to collect debt you owe; or (4) in connection with an investigation of suspected or actual unlawful activity.

Sale or Transfer of Business or Assets

We reserve the right to transfer Personal Information we have about you in the event we sell or transfer all or a portion of our business or assets (including, without limitation, in the event of a reorganization, dissolution, or liquidation).

Aggregate or De-Identified Data

We may share or make public aggregate or de-identified data derived from Personal Information. Such aggregate or de-identified data, however, will not identify you or any other individual.

HOW WE PROTECT INFORMATION

We maintain administrative, technical, and physical safeguards designed and intended to protect Personal Information against accidental, unlawful, or unauthorized destruction, loss, alteration, access, disclosure or use. Despite these safeguards, due to inherent uncertainty in the use of the Internet and information systems and the potential for unlawful attacks by third parties, we cannot guarantee that the use of our Sites or computer systems will be completely safe or secure.

TRANSFER OF PERSONAL INFORMATION

Personal Information we collect and use may be transferred, stored, and accessed globally to support our operations.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Information will take place to an organization or a country unless there are adequate controls in place including the security of your data and other Personal Information.

RETENTION

We retain information for as long as it is needed or useful to provide and improve our products and services, comply with our legal obligations, resolve disputes, and enforce our agreements.

YOUR INFORMATION CHOICES

We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Information. Whenever possible, you can update your Personal Information directly by logging into your Alacrity Account. If you are unable to change your Personal Information, please contact us at Privacy@AlacritySolutions.com to make the required changes.

 

  1. Your Rights

 

This section lists the privacy-related rights (“Rights”) we extend to you.  Your right to know and right to deletion are not absolute and are subject to certain exceptions. For example, we cannot disclose specific pieces of Personal Information if the disclosure would create a substantial, articulable, and unreasonable risk to the security of the Personal Information, your account with us or the security of our systems.

 

  • Right to Know– You have the right to know the Personal Information we collect, use, and disclose about you.
  • Right to Deletion– You have the right to request that we delete any Personal Information we have collected from you or maintain about you. We may save Personal Information when permitted by applicable law including, without limitation, when the information is needed for a legal purpose.
  • Right to Rectification– If you have an Alacrity Account, you may modify your Personal Information by contacting us at Privacy@AlacritySolutions.com.

 

You can also request that we provide you with a copy of your Personal Information in a commonly used electronic format so that you can manage and move it.

 

  1. Asserting Your Rights

 

You may exercise your right to know or your right to deletion by contacting us as set out in ”How to Contact Us” Section. We may ask you to verify your identity if you are contacting us through online chat, email, or phone. You may also designate an authorized agent to make a request to know or a request to delete. In order to be able to act, authorized agents have to submit proof that they are authorized to act on your behalf, or have a power of attorney. We may deny requests from authorized agents who do not submit proof that they have been authorized by you to act on their behalf.

For Personal Information that we have collected that is not accessible through the Alacrity Account, you can request, in writing, that we correct an error or omission to your Personal Information or delete your Personal Information.  We will respond to written requests within thirty (30) days, or alternatively, the timeframe prescribed by the relevant legislation.

 

OTHER IMPORTANT CONSIDERATIONS

Do Not Track

We do not collect personally identifiable information about users’ online activities over time and across third-party websites and we do not process or respond to “Do Not Track” signals from your browser or other mechanisms that enable consumer choice regarding the collection of Personal Information about one’s online activities over time and across third-party websites or online services.

Links to Other Websites

Our Sites may link to other websites for your convenience and information. For instance, we may link to websites of product suppliers, manufacturers, and service providers. These websites may be operated by companies not affiliated with us. Linked websites, including those operated by our affiliates, may have their own privacy notices, which we strongly suggest you review if you visit them. We are not responsible for the content or privacy practices of any website that we do not control and that does not point to this Privacy Statement. Your interactions with these websites are governed by the privacy policies of the company operating the websites.

Children

We do not knowingly collect personally identifiable information from anyone under the legal age of majority in the relevant province or state (a “Minor”). If you are a parent or guardian and you are aware that your Minor has provided us with Personal Information, please contact us. If we become aware that we have collected Personal Information from Minor without verification of parental or guardian consent, we take steps to remove that information from our servers.

Updates

This Statement may be updated periodically and without prior notice to you to reflect changes in our information practices or relevant laws. We will post a notice on the Sites to notify you of any substantive changes to the way we collect and use information.  We will indicate at the top of the Privacy Statement when it was last updated.

Additional disclosures apply for residents of California. The words used in this section have the meanings given to them in the California Consumer Privacy Act of 2018 (“CCPA”). The CCPA grants California consumers rights to know, access, and delete their Personal Information; to opt out of the sale of their Personal Information; and to not be discriminated against for exercising one of these California privacy rights.

Rights to Opt-Out, Know and Delete

Per the definition of “sell” in the CCPA, we do not “sell” Personal Information that we collect from you.

California residents have the right to delete Personal Information we have collected from you and the right to know certain information about our data practices in the preceding 12 months:

  • The categories of Personal Information we have collected about you;
  • The categories of sources from which we have collected the Personal Information;
  • The purposes for our collection of your Personal Information;
  • The categories of third parties with whom we share your Personal Information;
  • The purposes of our sharing your Personal Information with third parties; and
  • The specific pieces of Personal Information that we have collected about you.

Please note that we are obligated to verify identification and ensure that dissemination of Personal Information would not cause harm if it were distributed to another person. If we exercise our right to deny requests under certain circumstances, we will notify you of the reasons for the denial.

California’s Shine the Light Law

Subject to certain limitations under California Civil Code § 1798.83, if you are a California resident and have an established business relationship with us, you may ask us to provide you with (i) a list of certain categories of Personal Information that we have disclosed to certain third parties for their direct marketing purposes during the immediately preceding calendar year and (ii) the identity of certain third parties that received Personal Information from us for their direct marketing purposes during that calendar year. CATEGORIES OF PERSONAL INFORMATION, PURPOSES OF PROCESSING AND SOURCE 

See the “Information We Collect” and the “How We Use Information” Sections of the Statement for categories of Personal Information that we collect, for the purposes we use your Personal Information and, if applicable, the source from which the Personal Information originated.

SPECIAL CATEGORY DATA

Special categories of Personal Information include Personal Information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, data concerning health, data concerning an individual’s sex life or sexual orientation, genetic data, and biometric data processed for the purpose of identifying an individual.

With your consent, and if you choose to provide it, we may collect special category data, such as in our intake forms and initial assessments, and in your communications to Alacrity Solutions and its affiliates.

We process this Personal Information solely for the purposes of set out in the “Information We Collect” and the “How We Use Information” Sections of the Statement, in accordance with your explicit consent per Article 9(2)(a) GDPR. You can withdraw your consent at any time with future effect.

LAWFUL BASES FOR PROCESSING 

We rely on the following legal bases to process Personal Information of yours that does not fall within special categories, as appropriate:

  • According to your consent per Article 6(1)(a) GDPR (“Consent Legal Basis”)
  • Necessary for us to perform a contract with you or take steps at your request prior to entering into a contract per Article 6(1)(b) GDPR (“Contract Performance Legal Basis”)
  • Necessary for us to comply with an applicable legal obligation per Article 6(1)(c) GDPR (“Legal Obligations Legal Basis”)
  • Necessary in order to protect the vital interests of the data subject or another natural person per Article 6(1)(d) GDPR (“Vital Interests Legal Basis”), or
  • Necessary for us to realize a legitimate interest based on an assessment of that interest and your privacy and other fundamental interests per Article 6(1)(f) GDPR (“Legitimate Interest Legal Basis”), where the legitimate interests could be in particular:

  • Necessary to protect the vital interests of the data subject or of another natural person where the data subject is physically or legally incapable of giving consent

Your explicit consent will be obtained prior to processing special category information (or as soon as reasonably possible) and the purposes of such processing is outlined above. You retain the right to withdraw your consent at any time, with future effect, by contacting us at the contact details listed below. However, withdrawing consent may affect our ability to provide you with the Services. EU-U.S. DATA PRIVACY FRAMEWORK

We comply with the EU-U.S. Data Privacy Framework (EU-U.S. DPF) and the UK Extension to the EU-U.S. DPF as set forth by the U.S. Department of Commerce.

YOUR CHOICES

There is no law or contract between you and us stating that individuals in the EEA or UK or have to use our Services. We ask you to provide your name, organization, and eligibility information to verify your eligibility to receive certain Services from us. You do not have to provide Personal Information that is not shown as required to receive our.

You do not have to consent to our use of Personal Information for advertising purposes. If you do not allow us to collect the data we automatically collect from users of our Services, some of our Services may not work properly or be as tailored to you as they could otherwise be, but they will still generally be usable.

To the extent that you have given consent, you can withdraw your consent at any time with future effect by contacting us as described below. Such a withdrawal will not affect the lawfulness of the processing prior to the withdrawal of consent.

DATA RETENTION

See the “Retention” Section of the Statement for information on our data retention practices. Generally, your Personal Information will be stored by us/our service providers only to the extent necessary for the performance of our obligations and strictly for the time necessary to achieve the purposes for which the Personal Information is collected. Afterwards, we will securely destroy or delete your Personal Information unless we need to retain information, including Personal Information, to comply with legal or regulatory obligations to which we are subject.

YOUR RIGHTS
